THESE 2020 BOT LEADER RECONNAISSANCE BLIND CHESS COMPETITION LEGAL TERMS AND CONDITIONS ARE INCORPORATED INTO AND MADE A PART OF THE CONTEST RULES WHICH CAN BE FOUND AT https://rbc.jhuapl.edu/ranked2020/termsAndConditions (“RULES”). ENTRY IN THIS CONTEST CONSTITUTES YOUR ACCEPTANCE OF THESE RULES.

ENTRIES ARE FREE OF CHARGE. THERE IS NO LIMIT ON THE NUMBER OF ENTRIES PER PERSON OR TEAM. NO PURCHASE NECESSARY TO ENTER. ODDS OF WINNING DEPEND UPON THE NUMBER OF ELIGIBLE PARTICIPANTS IN THE CONTEST. Void where prohibited or otherwise restricted by law.

By participating in the 2020 bot leader reconnaissance blind chess competition you agree to these legal terms and conditions ("Terms") in addition to the Rules (which are incorporated herein). Please read the Terms carefully before participating. You must follow the directions provided within these Terms to be eligible to receive a Prize in connection with the Contest.

SPONSOR: This Contest is sponsored by The Johns Hopkins University Applied Physics Laboratory, LLC, 11100 Johns Hopkins Road, Laurel, Maryland 20723-6099 ("Sponsor," “Sponsor” or “Our”).

ELIGIBILITY: The Contest is open only to residents of the United States and worldwide, who are thirteen (13) years of age or older at the time of Entry (defined below), except that if you are a resident of Crimea, Cuba, Iran, Syria, North Korea, Sudan, or are subject to U.S. export controls or sanctions, you may not enter the Contest. Other local rules and regulations may apply to you, so please check your local laws to ensure that you are eligible to participate in skills-based competitions. Sponsor reserves the right to award alternative Prizes where needed to comply with local laws. Notwithstanding the prior sentence, this Contest is void where prohibited or restricted by law, rule or regulation. Officers, directors, and employees of Sponsor Entities (defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and their spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Contest. "Sponsor Entities" shall mean Sponsor and its parent, subsidiary, and affiliate companies, and administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Contest.

If an Entrant (or any member of an Entrant’s team) is not at least 18 years of age (or the age of majority in the Entrant’s jurisdiction at the time of Entry), such Entrant or member of Entrant’s team must have a parent or legal guardian indicate their assent to these Rules on behalf of such Entrant or team member by clicking, where indicated, at the end of these Rules (the “Parental Consent”). Failure to obtain and indicate such Parental Consent shall void any such Entry by an individual Entrant or any team Entrant with a minor team member who has not indicated the required Parental Consent.

HOW TO ENTER THE CONTEST: The Contest will begin on April 13, 2020 at 12:01 am, Eastern Daylight Saving Time (EDST) and will end on August, 31 2020 at 11:59 pm (EDST) (“Contest Period"). Those eligible individuals who agree to the Terms and the Rules of the Contest (the “Entrants”) will be entered into the Contest by following the directions below (an “Entry”), as described in these Terms. Entrants may either enter as individuals or as part of a team (“Team”). To enter the Contest during the Contest Period: 1) Entrants must go to the Sponsor’s site at https://rbc.jhuapl.edu; 2) create a bot following instructions on the Sponsor’s site or using one’s own methods; 3) register the bot on the Sponsor site; 4) connect the bot to play ranked games according to the documentation referenced on the Sponsor site; 5) if Entrant is a Team, list all Team members, all of whom agree to be bound by these Terms; and 6) follow all rules for participation in the Contest game play on the Sponsor site. To be eligible for a prize, a bot must have completed 100 games or more. Upon registration, each Entrant will set a password, which will be used to authenticate that Entrant's messages to the server. (Sponsor does not address more advanced networking or computer attacks such as someone sniffing traffic of another Entrant.) Failure to follow any instructions provided in these Terms may result in disqualification. There is no limit on the number of entries per person or team submitting an Entrant bot during the Contest Period. However, when a new version of a bot is connected to play a ranked game, all previous versions of the bot are no longer considered as potential winners; they become ineligible for all prizes. These previous versions become ineligible even if the newer bot has not played enough games to become eligible to win. Each team may consist of any number of persons.

ADDITIONAL RULES: All Entrants agree that all decisions of the Sponsor shall be final and binding with respect to all matters related to the Contest, and Entrants waive any right to challenge any decisions made by the Sponsor, and waive any right to claim any ambiguity in the Terms or any Entry.

Failure to follow any instructions provided in these Terms may result in disqualification. All materials submitted become the property of Sponsor, and Entries will not be acknowledged or returned. You are responsible for your costs of entering, including online access charges, etc. The time of receipt of any valid Entry shall be the time such valid Entry becomes available to Sponsor. Sponsor's computer shall be the official clock of the Contest.

By entering this Contest, an Entrant gives express permission to be contacted by Sponsor.

SELECTION OF WINNERS: Within twenty-one (21) days following the end of the Contest Period, Sponsor will compile a list of the final standings of the Entrants. Bots that have played less than 100 ranked games will be removed, and all versions of any bot prior to the latest connected version of that bot are also removed; they are ineligible for the prize. The overall winners (the “Winners”) for the Contest will be chosen based on the rankings of bots on the leaderboard as of the end of the Contest Period. Winning is subject to verification of eligibility. The decisions of Sponsor are final and binding with respect to all matters related to the Contest. Purchase or acceptance of a product offer does not improve your chances of winning.

PRIZES: A prize of $1,000 will be awarded to the Entrant (i.e., the registrar of the bot) with the highest ranking on the leaderboard considering the bots that have a registrar who is eligible for the prize. A prize of $500 will be awarded to the Entrant (i.e., the registrar of the bot) with the second highest ranking considering the same group of bots. Entrants consisting of Teams with members in common with other Teams are only eligible for one prize.

NOTIFICATION: Sponsor will notify each potential Winner at the e-mail address provided on the Sponsor Platform. Sponsor will make three attempts to contact a potential Winner via e-mail within 24 hours from the time of the drawing in which the potential Winner was selected. If Sponsor is unable to reach a potential Winner by e-mail within such 24 hour period, then that potential Winner will be disqualified and the next highest scoring Entrant shall be awarded the Prize. At the time of Sponsor’s contact with the potential Winner, the potential Winner will be asked to provide proof of their age, and a government-issued photo ID. IF A POTENTIAL WINNER IS UNDER 18, SUCH POTENTIAL WINNER’S PARENT OR LEGAL GUARDIAN MUST HAVE AGREED THAT THE MINOR POTENTIAL WINNER IS BOUND BY THESE RULES BY SUBMITTING THE PARENTAL CONSENT (AND BY EXECUTING AND DELIVERING TO SPONSOR SUCH OTHER DOCUMENTS OR INSTRUMENTS AS MAY REASONABLY BE REQUESTED BY SPONSOR IN CONNECTION WITH CLAIMING A PRIZE) IN ORDER TO BE ELIGIBLE TO RECEIVE A PRIZE. If the potential Winner fails to abide by the Terms, or is ineligible, Sponsor may select an alternate Winner from all remaining eligible Entries. Sponsor is not responsible for and shall not be liable for unsuccessful efforts to notify a potential Winner.

ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. Payments to potential winners are subject to the express requirement that they submit all documentation requested by Sponsor for compliance with applicable state, federal, local and foreign (including provincial) tax reporting and withholding requirements. Prizes will be net of any taxes that Sponsor is required by law to withhold. If a potential winner fails to provide any required documentation or comply with applicable laws, the Prize may be forfeited and Sponsor may select an alternative potential winner. Any winners who are U.S. residents will receive an IRS Form-1099 in the amount of their Prize.

LICENSE TO USE ENTRY: By submitting an Entry, you irrevocably grant to Sponsor and its affiliate, legal representatives, assigns, agents and licensees, the unconditional, perpetual, world-wide, non-exclusive, royalty-free right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), each element of your Entry, including but not limited to all submitted bot names, network data, including actions and their times, and any submitted software source code or binaries. Ownership of all intellectual property rights, including any intellectual property rights associated with software developed by Entrants, shall be retained by the Entrants, subject to any applicable third party rights.

PUBLICITY RELEASE: By submission of its Entry, an Entrant (and each member of Entrant’s team, if not an individual Entrant) grants to Sponsor, and each of its respective designees, the right to use or publicize such Entrant’s name, affiliation, if any, with an institution, address (city and state of residence), voice, statements, photograph and/or other likeness, for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation, and without further compensation, consideration, permission or notification, unless prohibited by law.

ENTRANT’S WARRANTIES, INDEMNITY AND RELEASE: Each Entrant (and, in the case of a team Entry, each member of such team) warrants that its Entry is Entrant’s own original work and, as such, Entrant is the sole and exclusive owner and rights holder of the Entry, and Entrant has the right to make the Entry and grant all required licenses. Entrant agrees not to make any Entry that: (i) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity or confidentiality obligations, or defames any person; or (ii) otherwise violates any applicable U.S. or foreign state or federal law.

To the maximum extent permitted by law, Entrant agrees to indemnify all Sponsor Entities at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any of Entrant’s acts, defaults or omissions and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, Entrant agrees to defend, indemnify and hold harmless the Sponsor Entities from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or accruing from: (a) Entrant’s Entry or other material uploaded or otherwise provided by Entrant that infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity or confidentiality obligations, or defames any person; (b) any misrepresentation made by Entrant in connection with the Contest; (c) any non-compliance by Entrant with these Rules or any applicable U.S. or foreign state or federal law; (d) claims brought by persons or entities other than the parties to these Rules arising from or related to Entrant’s involvement with the Contest; and (e) Entrant’s acceptance, possession, misuse or use of any Prize, or Entrant’s participation in the Contest and any Contest-related activity.

NO LIABILITY FOR INTERNET FAIILURES: Sponsor Entities are not responsible for any malfunction of the Sponsor Platform or any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed Entries or entry materials due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or at the Contest Platform, or any combination thereof, which may limit a participant’s ability to participate.

RELEASE/WAIVER OF LIABILITY: By participating in the Contest and submitting an Entry or accepting a Prize, each Entrant expressly agrees to forever waive, release, discharge, and covenant not to sue the Sponsor and/or the Sponsor Entities and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Contest, and all of their respective officers, directors, employees, agents and representatives (collectively, "Released Parties") of, for, and from any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses, actions and causes of actions whatsoever, of every nature, character and description (collectively “Claims”), known or unknown, including, but not limited to, all those arising out of or in any way related to the Contest; the Sponsor Platform; these Terms; Entrant’s Entry; the negligence of Sponsor any of the Released Parties; and any participation in the Contest. NOTHING IN THESE RULES LIMITS, EXCLUDES, OR MODIFIES OR PURPORTS TO LIMIT, EXCLUDE, OR MODIFY ANY STATUTORY CONSUMER GUARANTEE OR ANY IMPLIED CONDITION OR WARRANTY, THE EXCLUSION OF WHICH FROM THESE OFFICIAL COMPETITION RULES WOULD CONTRAVENE ANY STATUTE OR CAUSE ANY PART OF THESE OFFICIAL COMPETITION RULES TO BE VOID (“NON-EXCLUDABLE GUARANTEES”). SUBJECT TO THE LIMITATIONS IN THE PRECEDING SENTENCE AND TO THE MAXIMUM EXTENT PERMITTED BY ANY MANDATORY PROVISIONS OF APPLICABLE LAW, THE SPONSOR ENTITIES EXCLUDE FROM THESE RULES ALL CONDITIONS, WARRANTIES, AND TERMS IMPLIED BY STATUTE, GENERAL LAW, OR CUSTOM, EXCEPT FOR LIABILITY IN RELATION TO A NON-EXCLUDABLE GUARANTEE. SUBJECT TO ANY NON-EXCLUDABLE GUARANTEES, EACH INDIVIDUAL PARTICIPANT AGREES TO RELEASE, HOLD HARMLESS, AND INDEMNIFY (I.E., DEFEND AND/OR REIMBURSE) THE SPONSOR ENTITIES FROM ANY LIABILITY WHATSOEVER FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE USE, ACCEPTANCE, POSSESSION, MISUSE, OR AWARDING OF A PRIZE OR WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELING TO OR FROM ANY CONTEST-RELATED OR PRIZE-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY (HOWEVER (BUT ONLY IF REQUIRED BY LAW IN YOUR JURISDICTION). THIS RELEASE, HOLD HARMLESS, AND INDEMNIFICATION COMMITMENT DOES NOT APPLY TO CASES OF BODILY INJURY OR LOSS OF LIFE OR TO THE EXTENT THAT ANY DEATH OR PERSONAL INJURY IS CAUSED BY THE NEGLIGENCE OF SPONSOR OR OTHER THIRD PARTY, WHERE LIABILITY TO THE INJURED PARTY CANNOT BE EXCLUDED BY LAW). EACH WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE (EXPRESS OR IMPLIED, IN FACT OR IN LAW), WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, BEYOND ANY NON-EXCLUDABLE GUARANTEES. FURTHER, ENTRANT AGREES THAT THE COMPETITION ENTITIES ARE NOT RESPONSIBLE IN ANY WAY FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR RE-ROUTING RESULTING FROM ANY ACTS OF ANY GOVERNMENT OR AUTHORITY.

PRIVACY POLICY: You acknowledge and agree that Sponsor and Sponsor Entities may collect, store, share and otherwise use personally identifiable information provided by you during the Contest registration and Contest, including but not limited to, name, mailing address, phone number, and email address (“Personal Information”). Sponsor acts as an independent controller with regard to its collection, storage, sharing, and other use of this Personal Information, and will use this Personal Information in accordance with its Privacy Policy https://www.jhuapl.edu/Home/Privacy. You have the right to request access to, review, rectification, portability or deletion of any personal data held by Sponsor about you by contacting Sponsor at neurips_rbc_comp@listserv.jhuapl.edu. As a controller of such Personal Information, Contest Sponsor agrees to comply with all U.S. and foreign data protection obligations with regard to your Personal Information. Such country may not have privacy laws and regulations similar to those of the country of your residence.

GENERAL CONDITIONS: All federal, state, provincial and local laws and regulations apply. Released Parties are not responsible for late, incomplete, illegible, inaccurate, undelivered, or garbled entries, interrupted or unavailable network or other connections; misdirected, blocked, or delayed notifications; printing, typographical or other errors appearing within these Terms, in any Contest-related advertisements or other materials; or any other errors, problems or difficulties of any kind relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the operation of the Sponsor Platform, the announcement of the Prize or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to Entrants or to any other person's computer related to or resulting from participating in this Contest. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Prize (or any portion thereof), and (ii) disclaim any implied warranty. Sponsor's failure to enforce any term of these Terms shall not constitute a waiver of any such term. If any provision of these Rules is held to be invalid or unenforceable, all remaining provisions of the Rules will remain in full force and effect.

DISPUTE RESOLUTION; GOVERNING LAW; JURISDICTION:

Except where prohibited by law, any and all disputes, claims, and causes of action between you and any Sponsor Entity arising out of or connected with this Contest, the determination of any winner, or any prize awarded must be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will any Contest participant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than the individual participant’s actual out-of-pocket expenses (if any), not to exceed ten dollars ($10 USD), and each individual participant further waives all rights to have damages multiplied or increased.

The Contest, the Rules and all disputes will be resolved under the laws of the internal substantive laws of the State of Maryland, without regard to its conflicts of laws principles, and the laws of the United States. All disputes arising out of or with respect to this Contest or these Terms shall be heard exclusively in the courts, state and Federal, located in Baltimore, Maryland, United States of America, and by entering the Contest, each entrant agrees to the exclusive jurisdiction and venue of such courts.

CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE ANY WEBSITE OR PLATFORM ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT, AND SPONSOR AND/OR ITS AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

RIGHT TO CANCEL CONTEST: Sponsor reserves the right, in its sole discretion, to cancel or suspend the Contest (or any portion thereof) at any time. In the event of cancellation, Sponsor may elect to identify the Winner by the then-current standings in the Contest at the time of such cancellation. Sponsor reserves the right, in its sole discretion, to modify these Terms for clarification purposes without materially affecting the terms and conditions of the Contest.

WINNERS LIST: For a list of the Winners (available after September 21, 2020) mail a request and self-addressed stamped envelope to: RBC Competition, Ryan Gardner, 11100 Johns Hopkins Rd, Mail-Stop 4-335, Laurel, MD 20723. The Winners list requests must be received by October 21, 2020.
